Terms of Service Provided Electronically

§ 1. General provisions

1. These terms (hereinafter: “Terms”) set out the rules for providing services electronically via the website available at atom-db.eu (hereinafter: “Website”).
2. The Service Provider is ATOM D&B sp. z o.o. with its registered office in Wrocław, Aleja Śląska 1, 54-118 Wrocław, KRS 0001154928, NIP 894-325-17-02, REGON 540469150 (hereinafter: “Service Provider”).
3. The Terms are made available free of charge at this URL in a manner allowing their retrieval, reproduction and storage.

§ 2. Definitions

• User — a natural person, legal person or organisational unit without legal personality using the Website.
• Services — services provided electronically, in particular making available information about the Service Provider’s activity, contact and application forms.
• Means of electronic communication — technical solutions, including e-mail, enabling individual remote communication.

§ 3. Types and scope of services

1. The Service Provider provides the following services electronically:
   • Making available informational content about ATOM D&B’s activity (portfolio, sectors, cooperation models)
   • A contact form for submitting a request for quotation (biuro@atom-db.eu)
   • An application form for contractors / pre-qualification (biuro@atom-db.eu)
   • Formularz aplikacyjny dla kandydatów na stanowiska pracy (biuro@atom-db.eu)
2. Use of the services is free of charge.

§ 4. Technical requirements

Proper use of the Website requires:

• An end device with access to the Internet
• An up-to-date web browser (Chrome, Firefox, Safari, Edge — versions from the last 2 years)
• JavaScript and cookies enabled (for some functions)
• Aktywne konto poczty elektronicznej (dla korzystania z formularzy)

§ 5. Terms of service provision

1. Korzystanie ze Strony jest dobrowolne.
2. The User is obliged to use the Website in accordance with the law and good practice, respecting the rights of third parties.
3. The User is prohibited from providing unlawful content, in particular:
   • Infringing the personal rights of others
   • Infringing copyright and related rights
   • Constituting a threat, insulting or violating the dignity of others
   • Constituting SPAM or unsolicited commercial information
   • Containing malware, viruses or exploits

§ 6. Service Provider’s liability

1. The Service Provider makes efforts to keep the Website available 24 hours a day, 7 days a week.
2. The Service Provider reserves the right to periodic technical breaks in the Website’s operation necessary for maintenance, updates or repairs.
3. The Service Provider is not liable for interruptions in the Website’s operation caused by circumstances beyond its control (including force majeure and provider-side failures).
4. Content on the Website is informational and does not constitute a commercial offer within the meaning of Art. 66 § 1 of the Civil Code, unless expressly stated otherwise.

§ 7. Complaints

1. Complaints regarding services provided electronically may be submitted to: biuro@atom-db.eu
2. A complaint should include: contact details, a description of the problem and the expected resolution.
3. The Service Provider examines complaints within 14 business days of receipt.

§ 8. Personal data protection

The rules for processing Users’ personal data are described in the Polityce prywatności.

§ 9. Final provisions

1. These Terms are effective from the date of their publication.
2. The Service Provider reserves the right to amend the Terms at any time. Changes take effect upon publication on the Website.
3. In matters not covered by the Terms, Polish law applies, in particular:
   • The Act of 18 July 2002 on providing services electronically
   • The Act of 23 April 1964 — Civil Code
   • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR)
4. Disputes arising from use of the Website are settled by the court with local jurisdiction over the Service Provider’s registered office.
